NHTSA Opens Investigation Into Tesla Cybercab Safety Certification After Austin Launch

Federal auto-safety regulators have opened an investigation into how Tesla certified its new Cybercab as meeting federal safety standards after the driverless vehicles began commercial deployment in Austin, Texas. The National Highway Traffic Safety Administration opened Audit Query AQ26002 on September 3, the same day Tesla began deploying a small number of Cybercabs commercially in Austin.
Unlike a conventional passenger vehicle, the Cybercab doesn’t have permanently attached traditional manual controls such as a steering wheel, brake pedal, accelerator pedal or mirrors. That’s now at the center of an unusual federal compliance review.
NHTSA Is Reviewing Tesla’s Self-Certification
Automakers don’t normally send each new vehicle model to NHTSA and wait for the government to approve it before selling it. Instead, manufacturers are responsible for certifying that their vehicles comply with all applicable Federal Motor Vehicle Safety Standards, commonly known as FMVSS. NHTSA establishes those requirements and oversees manufacturers to confirm compliance.
Tesla notified NHTSA that the Cybercabs it deployed in Austin had been certified as complying with all applicable federal safety standards. The agency is now examining the process and technical information Tesla used to reach that conclusion. NHTSA’s official investigation record lists an estimated population of 1,000 Cybercab vehicles, although that figure shouldn’t be interpreted to mean 1,000 Cybercabs were already operating commercially in Austin when the inquiry began.
Why the Missing Steering Wheel and Pedals Matter
Many existing federal vehicle standards were written around automobiles designed to be controlled by human drivers. Cybercab presents a fundamentally different design. NHTSA says the vehicles lack permanently attached conventional controls including a brake pedal, accelerator pedal, steering wheel and mirrors.
The agency is currently working on multiple rulemakings intended to update federal standards for automated vehicles, including requirements involving brake pedals, windshield wipers, lighting and rearview mirrors.
Those updates aren’t finished yet.
NHTSA emphasized that existing federal safety standards remain in effect while that regulatory work continues.
NHTSA Wants to Know Which Standards Tesla Says Don’t Apply
One particularly important part of the investigation involves how Tesla interpreted existing federal rules. NHTSA says it will examine whether Tesla’s certification framework depended on determining that certain standard FMVSS requirements are inapplicable to Cybercab. That doesn’t mean NHTSA has concluded Tesla incorrectly certified the vehicles.
Instead, regulators are reviewing the technical data and processes Tesla used to decide which requirements apply to a purpose-built automated vehicle without conventional driver controls. That distinction is important because the inquiry is about the legal and technical basis for Tesla’s self-certification—not a government announcement that Cybercab has failed a specific safety test.
Tesla Has Already Begun Commercial Deployment
The timing makes the federal review particularly notable. According to NHTSA’s investigation record, Tesla began commercial deployment with a small number of Cybercab vehicles in Austin, Texas, on September 3.
Tesla also told the agency that it plans to gradually expand Cybercab commercial deployment to additional vehicles and locations.
NHTSA announced the investigation publicly on September 4. The agency characterized the Audit Query as an enforcement action intended to determine whether Tesla’s self-certification complies with existing federal requirements as the government continues updating its rules for automated vehicles.
This Isn’t a Cybercab Recall
Consumers should be careful not to interpret the investigation as a recall or a finding that Cybercab is defective. NHTSA hasn’t announced that Cybercab violates a particular Federal Motor Vehicle Safety Standard, nor has the agency announced a recall through AQ26002. The inquiry is currently open.
What happens next will depend on what NHTSA finds when it examines Tesla’s certification process, technical data and interpretation of the federal standards that apply to the vehicle. For now, the central question isn’t whether regulators have declared Cybercab unsafe. It’s whether Tesla can demonstrate that a purpose-built driverless vehicle without the controls found in conventional cars satisfies every federal safety requirement that legally applies to it.
Why the Investigation Could Matter Beyond Tesla
The Cybercab inquiry also highlights a broader issue facing the auto industry as companies develop vehicles that no longer assume a human will be sitting behind a steering wheel. Federal safety standards developed for conventional vehicles don’t always map neatly onto vehicles designed from the beginning to drive themselves. NHTSA is already working to modernize several of those requirements, but manufacturers deploying automated vehicles must still comply with the rules currently in force.
How regulators ultimately handle designs without steering wheels, pedals and other traditional equipment could affect not only Tesla but the wider commercial robotaxi industry. For consumers, it could also shape how quickly purpose-built autonomous vehicles expand to additional cities and what safety requirements manufacturers must satisfy before those vehicles become a common part of everyday transportation.
